4. 380 Classic Rd./549 Park West Boulevard

A. Forest management activity waiver from 5-year development limitation placed upon Jennings Mill Corners subdivision.


Request:  Mr. Coleman has submitted an application requesting a waiver from ACC Code Section 8-7-18 (Forest management activities), specifically the first sentence under paragraph [8-17-18 (i)(1), Development limitations], which requires that a Notice of Timber Harvesting be submitted to the Planning Department prior to timber removal. If such notice is not submitted prior to a timber harvest, a five-year limitation for development of the subject property is imposed. The Planning Department recognized that clearing had occurred during construction of single family homes in the subdivision. The original Tree Management Plan showed conserved canopy along the North, South and East edges of the subdivision along with parcel 073A6 A099; the clearing was noticed during site construction and had not been approved through a Timber Harvest permit. The extent of clearing requires a timber harvest application; however, due to the clearing taking place, an administrative permit cannot be issued. A notification of violation was sent to the property owner and general contractor. A. The request is to waive the five-year development limitation for unapproved timber harvesting
